ORDERING TERMS AND CONDITIONS

Shipping: Orders are shipped FOB Bethlehem, PA, or factory, at the discretion of CriticalTool, Inc. (“CriticalTool”), unless otherwise agreed to by CriticalTool. Orders are usually processed, packaged and shipped within 24 hours of your order. Need next-day delivery? Ask your Customer Service Representative for details. We prepay and add shipping charges. We offer free shipping on orders of $99.00 (some exclusions apply) shipping to the continental US. Alaska & Hawaii deliveries do not qualify for free shipping.  We do not ship to Mail Forwarding Service Addresses and will cancel any orders with a ship-to address of a Mail Forwarding Service.

Backorder Policy:  In the event that an item is on backorder, we will not ship the order until all items are available.  Customers may request a partial shipment, however additional shipping charges may apply.  This policy does not apply to orders in excess of $250.00.

Claims: We take great care in filling, checking and packing your order. On rare occasions, a package may be damaged or lost in transit. If a truck shipment is damaged, please note the damage on the delivery receipt. Then call us at 1-800-511-8652.

Refund & Return Policy

If you’re not satisfied with your purchase for any reason, you can return it within 30 days for a full refund.  We cannot accept returns for any item received after 30 days of the delivery date .  We must be notified of all returns within 30 days of receipt.  CriticalTool reserves the right to inspect all returned items. If items are not returned in good condition or with original packaging, credit will not be issued. To receive your 100% refund, you must call our Customer Service Department for your Return Authorization Number before returning items: 1-800-511-8652. 

We are not responsible for :

- Defective items not reported to CriticalTool within 30 days of receipt

- Items returned to our warehouses without a Return Authorization Number

- Items returned to CriticalTool without contacting CriticalTool prior to the return.

- Items returned without original packaging  all documents & instruction booklets that were included with original shipment

Defective Items: Any defective items must be reported to CriticalTool within 30 days of receipt. As a distributor and not a manufacturer, CriticalTool Inc. has no control over certain aspects of product quality. There are items that may have a natural flaw or may have a service life less than what may be expected; natural flaws and failure to meet individual expectations are not considered defects. CriticalTool, Inc. will not be liable for any defective items NOT reported within the 30-day policy. Any guarantee that is offered by the product manufacturer in the form of a label or similar marking on the product must be addressed by contacting the manufacturer directly.  Normal wear and tear of an item does not constitute defectiveness.  Acceptance of returns on any item said to be defective will be made at the discretion of CriticalTool, Inc. CriticalTool, Inc. assumes no product liability. Buyer assumes all risk pertaining to use and application of any purchase.

Custom Orders:  Any custom orders are non-refundable and non-returnable.

Special Orders:  Periodically we may be able to supply for a customer an item that is not in our normal inventory and does not appear on our website.  These items are non-refundable and non-returnable.

Prices: Prices shown are subject to change. All published prices are in U.S. dollars and must be paid in U.S. dollars. Please note: We require a $25.00 minimum order.

Payment: We accept Master Card, Visa, American Express, and Discover. C.O.D. payments are not accepted. Net 30 terms are available for certain corporate accounts. Please speak with a customer service representative for details.

Local Safety Standards and Regulations: Products sold by CritcalTool are designed to meet stated U.S. safety standards and regulations. Because local safety standards and regulations vary, CriticalTool cannot guarantee that our products meet all applicable requirements in each locality. The purchaser assumes responsibility for compliance with such safety standards and regulations in those localities in which the products will be shipped, sold and used.

Shipping Hazardous Products: Products considered hazardous for shipping will require special packaging, handling and additional shipping charges. For specific details and charges, call 1-800-511-8652

Limited Warranty: Except as described in our guarantee, there are no express warranties or implied warranties including, but not limited to, merchantability and fitness for a particular purpose. CriticalTool shall not be subject to and disclaims: (1) any other obligations or liabilities arising out of breach or contract or of warranty, (2) any obligations whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by CriticalTool, or any undertakings, acts or omissions relating thereto, and (3) all consequential, incidental and contingent damages whatsoever.

Exclusion of Warranties/No Warranties Disclaimer:  Buyer acknowledges that Seller is not the manufacturer of the products or goods sold.  The implied warranties of merchantability and fitness for a particular purpose and all other warranties, express and implied, are excluded from this transaction and shall not apply to the goods sold.  In no event shall Seller be liable to Buyer for indirect, special or consequential damages or for loss of anticipated profits on any claim of any kind resulting from any order hereunder.

These terms and conditions shall constitute the entire agreement between CriticalTool and the purchaser, and shall be governed by and construed according to the laws of the state of Pennsylvania and the United States of America. Orders placed constitute an agreement to the above terms.
